Trademarks and Service Marks

The name “Scoilnet” and associated logos are trademarks of PDST Technology in Education (formerly NCTE) and are protected by Irish law. Except for purposes of attribution as required by and in compliance with the Creative Commons Licence and the Terms & Conditions, you may not use the Scoilnet logo, or any variations thereof, for any purpose or in any manner, without express prior written consent of Scoilnet. Without limitation to the generality of the foregoing, you may not use the Scoilnet logo for advertising, promotional or marketing purposes, or for seeking commercial or monetary gain, or in any way that deliberately or inadvertently claims, suggests, implies, or in Scoilnet’s sole judgment gives the appearance or impression of, any association, connection or affiliation with Scoilnet (other than a truthful, non-misleading indication that you are a User of the Scoilnet Website), or any endorsement, sponsorship or approval by Scoilnet or PDST Technology in Education.

Unless otherwise noted, all other trademarks and service marks appearing on the Scoilnet Website are the property of their respective owners.

Scoilnet Legal Notices

To the extent any Scoilnet-created Content contains or includes any Scoilnet legal disclaimers, Scoilnet’s trademark, copyright and/or other legal rights notices, and/or Scoilnet′s source, identification and/or attribution information (collectively “Scoilnet Legal Notices”), you must keep intact all such Scoilnet Legal Notices, and may not remove, alter, destroy, conceal or otherwise temper or interfere with the same.

Copyright of Scoilnet-created Content

Scoilnet-created Content includes all editorial content displaying on the Scoilnet website, as well as, but not limited to, reviews and descriptions of resources, suggestions for use, proposed curriculum mappings, News and interactive learning objects. All Scoilnet-created Content is protected under Irish and European law. Scoilnet owns and retains all rights, title and interest, including all rights under copyright, in and to all Scoilnet-created Content. Your rights to use, share and adapt Scoilnet-created Content under the Creative Commons Licence are merely those of a non-exclusive licensee, and you do not acquire copyright ownership with respect to any Scoilnet-created Content.

Scoilnet-created Content – Our Licence to You

Except as expressly otherwise noted, all Scoilnet-created  Content is made available to Users in accordance with the Creative Commons Attribution-Share Alike 3.0 Unported (CC BY-SA) Licence (http://creativecommons.org/licenses/by- sa/3.0/ie/), as amended and updated by Creative Commons from time to time (the “CC BY-SA Licence”), which is incorporated herein by this reference.

The CC BY-SA Licence allows you to freely share and adapt Scoilnet-created Content, provided that: 

  1. you give proper attribution to Scoilnet in the manner specified by Scoilnet, but not in any way that suggests that Scoilnet endorses you or your use;
  2. you may use, copy, reproduce, perform, display, distribute, transmit, disseminate, modify, adapt, build upon the material, or otherwise exploit Scoilnet- created Content copy in any medium or format, for any purpose, even commercially, as long as you distribute your contributions under the same BY CC-SA licence;
  3. for any reuse or distribution of Scoilnet-created Content, you must make clear to others the CC BY-SA Licence terms (the best way to do this is with a link to creativecommons.org/licenses/by-nc/3.0/ie; and
  4. you comply with all other requirements as may be specified in the CC BY-SA License. The CC BY-SA licence supersedes and replaces any other licence previously adopted by Scoilnet for Scoilnet-created Content.

NOTE: Notwithstanding the above, the CC BY-SA Licence does not apply to photos, images, illustrations and other materials contained in Scoilnet-created Content which have been licensed by Scoilnet from individuals and/or other commercial stock photo/image agencies (you can easily identify such a photo or image by looking at the credit embedded within or associated with the photo or image) (each, a “Licensed Stock Photo”). You are allowed to retain a copy of a Licensed Stock Photo for your own personal, non-commercial use only, BUT (i) you may not modify, alter, adapt, or otherwise create any derivative work from, a Licensed Stock Photo and (ii) you may not distribute, transmit or disseminate a Licensed Stock Photo or any copy or derivative work thereof, to any third party, whether by itself, as part of Scoilnet- created Content, or otherwise.

If you wish to use Scoilnet-created Content for commercial purposes, you should contact Scoilnet in advance of this as it may be necessary to enter into a separate licence agreement governing commercial use of the Scoilnet-created Content if the “Share-Alike” element of the CC BY-SA licence is not being implemented.

If you do not agree to the terms of the CC BY-SA License, please refrain from using Scoilnet-created Content in any manner, including downloading, copying, reproducing, printing, editing, modifying, distributing or transmitting such content, in any media or by any means, whether now known or hereafter developed. If you accept the terms of the CC BY-SA Licence and proceed to use any Scoilnet-created Content, then any breach or violation by you of the CC BY-SA Licence will automatically constitute a violation of the Terms of Use and may subject you to liability to Scoilnet for copyright infringement. Also, to the extent you have violated the CC BY-SA Licence and made modifications or improvements to, or have prepared derivative works based upon, Scoilnet-created Content or have otherwise incorporated Scoilnet-created Content into your own content, your violation of the CC BY-SA Licence will automatically subject such modifications, improvements or derivative works by you, or your own content that is mixed with Scoilnet-created Content, to a perpetual, royalty-free, worldwide licence to Scoilnet, and Scoilnet may, in its sole discretion, elect to exercise the foregoing licence in addition to or without prejudice to any other remedies available.

User-uploaded content – Your Licence to Scoilnet

Certain functions of the Scoilnet Website allow Members (and only Members) to make, publish, share and store their Content on the Scoilnet Website, as well as the ability to view, access, and further adapt and build upon Content uploaded by other Members. Members retain copyright ownership in their Content on the Scoilnet Website, PROVIDED that by uploading content on the Scoilnet Website, you hereby expressly and irrevocably grant to Scoilnet a non-exclusive, royalty-free, worldwide, perpetual licence to freely display, use, copy, reproduce, perform, distribute, transmit, disseminate, adapt, create derivative works from, and otherwise exploit (with the right to authorise and grant sublicences to others to do so) your Content, whether within the Scoilnet website, or otherwise, for any and all non-commercial purposes as Scoilnet deems appropriate, and in any and all media now known or hereafter devised.

The Scoilnet website links to external organisations or websites over which Scoilnet has no control and accepts no responsibility. Any references or links on the Scoilnet website to external organisations or websites are provided as a matter of convenience only. They should not be taken as an endorsement of those organisations.

The Scoilnet website also contains third party owned content (e.g. articles, image libraries, data feeds or abstracts) and may also include hypertext links to third party owned websites. We provide such third party content and links as a courtesy to our users. Links are provided for your information only. We have no control over any third party owned websites or content referred to, accessed by or available on this website.  This content is NOT covered by Scoilnet’s Creative Commons Licence. Users should always consult the copyright notices within these websites prior to use or re-use of their content.

To the extent permitted by law, therefore, we do not endorse, sponsor, recommend or otherwise accept any responsibility for such third party websites or content, or for the availability of such websites. In particular, we do not accept any liability arising out of any allegation that any third party owned content (whether published on this, or any other, website) infringes the intellectual property rights of any person, or any liability arising out of any information or opinion contained on such third party website or content.

Objecting to Content on Scoilnet

If you object to the publication of any material including User-Uploaded Content placed on Scoilnet either because you think it might infringe your intellectual property rights or it is offensive/prohibited content, please let us know by clicking on the “Report this resource” link next to the relevant resource. Examples of objectionable material within User-Uploaded Content include discrimination (for example based on race, religious belief or sexuality) or offensive language or pornographic material. The “Report a Resource” button is the fastest way to notify us and will provide a direct link to the content in question.

In order to protect our users, Scoilnet operates a notice and take down system. If you contact us via the “Report this resource” link that you object to any material placed in Scoilnet, we will upon receipt of your objection expediently investigate the reported User-Uploaded Content, decide whether your objection is valid and the User-Uploaded Content needs to be removed, in which case we will remove the material.
